Who can hang gutters on a Florida home, and does the job need a permit?

Short answer

Section 489.105 puts fascia repair or replacement needed during a roof job inside the roofing contractor's scope, but it doesn't name gutters, so put the license question to DBPR's 'Do I Need a License?' tool. Your city or county building office answers the permit question for your address.

What a gutter job involves

The job takes down the old runs, checks the fascia board behind them and hangs new gutters and downspouts pitched toward the outlets. When rotted fascia is replaced during a roof repair or replacement, section 489.105 counts that board work as part of the roofing contractor's scope.

GutterDownspoutSplash block
A gutter hangs on the fascia at the roof edge and sends water through the downspout out onto the ground away from the house.

Repair or replace the gutters

A loose hanger or one leaking seam can be fixed where it is. Rotted fascia means the gutter comes down so the board behind it can be replaced.

Usually a repair
  • A single seam leaks or a hanger has loosened.
  • The fascia is sound.
Usually a replacement
  • The runs sag along most of the house.
  • The fascia needs replacement and the gutters have to come off to reach it.

Which license the work falls under

DBPR's contractor page lists 'Do I Need a License?' beside 'Verify a License' and 'Find a Licensed Contractor'. If the same contract includes roofing, section 489.13 treats doing it without an active certificate or registration as unlicensed contracting, with an administrative fine of up to $10,000.

Gutters in the same contract as a new roof

A roof repair or replacement contract has to carry the bold notices section 489.147 requires, among them the one telling you to check coverage and deductible with your insurer before signing if a claim is involved. Section 489.1425 separately requires a written statement of your Recovery Fund rights in residential contracts above $2,500.

When gutter trouble cannot wait

Call right away
  • A run has pulled away and is pouring water against the foundation or siding.
  • Fascia behind the gutter is soft and the edge of the roof is sagging.
Can usually wait for a normal appointment
  • Leaves in the gutter with water still draining.
  • A seam that weeps slowly in a heavy rain.

Before you hire a gutter company

  1. Ask whether the quote includes fascia repair and at what price per board.
  2. Ask the building office whether your address needs a permit for gutters.
  3. Check the company's license on MyFloridaLicense.com if the contract touches the roof edge.

Does a gutter job need a permit?

Section 553.79 has local governments exempt a single-family owner, or the owner's contractor, from a building permit for work valued under $7,500 when they file a written request with the contract. The exemption doesn't reach a flood hazard area or electrical, plumbing, structural, mechanical or gas work. Your building office decides if a gutter job fits.

Florida licenses roofing contractors through DBPR, so before any work starts, ask for the license number and look it up on DBPR's license search.
